TERMS AND CONDITIONS 

These terms are taken to be acknowledged and accepted by our Customer upon making an order from MINIKEGz on this website or by other

 

means.

 

Eligibility to Purchase

We support responsible service of alcohol.  It is against the Law to sell or supply alcohol to (or obtain on behalf of) a person under the age of 18 years old at time of order.  It is a condition of purchase that you verify that you are 18 years of age or over.  If you do not so verify then your order will not be processed.

We reserve the right to restrict quantities of an item being shipped to any one Customer or postal address.

Acceptance of your Order

Once placed you will receive an email acknowledging your order.  We reserve the right not to accept your order in our absolute discretion and shall

 

not be liable to you or any third party by reason of such non-acceptance.

 

The parties agree that that the order is placed in Victoria regardless of the Customers place of business or residence or the point of delivery. 

 

Our contract shall cease once payment has been made and your order dispatched. 

Payment

Payment can be made by any manner permitted on site.  Payment will be debited and cleared from your account upon dispatch of your order by

 

Us. 

 

By ordering you are confirming that the credit/debit card that is being used is yours or that you have been specifically authorised by the lawful

 

owner of the  credit/debit card to use it.   You are also authorising us to debit the presented card with the value of the order (including delivery) in

 

AUD.  All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to

authorise payment to Us we will not be liable for any delay or non-delivery.

We take reasonable care to make our Site secure and adopt SSL encryption.  We also recommend that you take appropriate security precautions

 

when accessing the Internet via public Wi-Fi networks or shared computers.

Privacy Policy

MINIKEGz is dedicated to keeping your details private. Any information, we collect in relation to you, is kept strictly secured. We

 

do not pass ​ on/sell/swap any of your personal details with anyone. We use this information only to identify your orders, provide

 

you with our newsletter (if you choose to have it delivered) and to personalise your shopping experience with us. MINIKEGz

 

may use cookies to allow you to login to your account, maintain a shopping cart and to purchase items in your shopping cart. 

Pricing Policy

All of our prices are in Australian dollars (AUD) and include GST (Goods and Services tax).  Product prices are regularly updated when price

 

changes are received from our suppliers.

Shipping Delivery Policy and Postage

We may deliver products Australia wide using our own vehicles, Australia Post or private courier services  Shipping costs are influenced by the size

 

and weight of the product and your location. Exact shipping costs are calculated in the shopping cart and will be added to the order total before

 

checkout.

We will endeavour to ship orders to you as soon as possible but the speed of dispatch will vary.  As an order may comprise products from

 

different suppliers (mixed cases) we may sometimes need to source additional stock before filling your order which takes extra time.   Sometimes

 

the items ordered may ship to you separately, perhaps direct from a supplier.  However, we strive to have most orders dispatched within 3 business

 

days.  Shipping times are estimated at between a further 2-7 business days depending on your location within Australia.

Postage/delivery quotations may be generated automatically. In rare instances when a mistake with postage or delivery charge occurs we reserve

 

the right to adjust that postage or delivery overcharge or undercharge and to withhold or cancel any order until the correct postage amount has

 

been sorted.  If the error is discovered after postage or delivery both parties agree to reconcile any adjustment at that time. 

Local Liquor laws or courier policies may differ in different States or Jurisdictions. On same occasions an order cannot be left unless personally with

 

an individual present at the delivery address and over 18 years of age.  The courier may need to request identification from the recipient to verify

 

the recipients age.  In that event the courier is unable to leave the order at the address or with an adult a notification shall be left advising alternate

 

pickup or delivery arrangements.  We shall not be liable for any additional costs incurred as a result.

Returns and Refunds: Procedure and Policy

Leaks and/or Lost Product

All gear supplied by MINIKEGz must be tested thoroughly by the Customer before use and maintained correctly over time. MINIKEGz is not

 

responsible for lost beer/beverages, liquid, gas or other consumables caused or contributed by lack of maintenance or care.

Faulty Product or Product not as Described

MINIKEGz will not accept a return if you have changed your mind or ordered the wrong product.  However, in the event you have received an order

 

from MINIKEGz and it is not what you ordered or how it should be due to damage, poor quality, spoiled contents, poor craftsmanship or otherwise

 

you are required to contact us at first opportunity in which case such claims will be handled in the following manners:

For Non-Perishable Items

 

Unless stated otherwise we shall warrant all such items for a period of 90 days from date of purchase. If a fault in the product (not caused by the

 

Customer) has been identified within that period, and MINIKEGz has likewise been made aware, the customer shall return the product to us for

 

assessment.  We shall assess the product within 7 days and (if identified determined a fault not caused by the customer or by lack of maintenance)

 

MINIKEGz may at its option either repair, refund or replace the item and meet the cost of ordinary freight.  On occasion MINIKEGz may (in its

 

absolute discretion) elect to replace the item without assessment.  

For Perishable Items

 

Unless otherwise stated we shall warrant such items for a period of 30 days from date of purchase.  Any notification/complaint shall be identified

 

and specified in writing to MINIKEGz at first opportunity providing adequate detail.  If requested the Customer must return the item (or the

remaining portion) to us for assessment.  In that event we shall assess the item within 7 days and (if identified and determined a fault not caused by

 

the customer or lack of hygiene practices) MINIKEGz may at its option either replace or refund the item and meet the cost of ordinary freight.  On

 

occasion MINIKEGz may (in its  absolute discretion) elect to replace the item without assessment.  

The customer acknowledges that:

  • beverages  (like any food) are perishable

  • minikegs should be refrigerated upon delivery and kept cold until use

  • minikegs should never be left in the sun, in a vehicle or in extreme heat

  • 3L minikegs are designed for single use only and are not designed for refill

  • dispensing equipment including any keg, tap or hose or tubing in contact with any beverage needs regular sterile cleaning and are prone to carry or transmit infection if not adequately maintained and sterilised

  • minikegs may be removed and replaced on a dispenser but should be consumed within a maximum of 7 days of first dispense

For Perishable and Non-Perishable Items

If requested the Customer agrees to supply photos or video evidence of any fault or defect to MINIKEGz in order to assist any claim.  We shall NOT

 

be responsible for any costs, repair charges or freight incurred by the Customer without our prior knowledge or agreement. Our liability shall be

 

limited to item replacement and not extend to any consequent loss or damage.  Any damage to products due to inadequate packaging by the

 

Customer shall NOT be borne by us.

Warranty shall not apply:

 

  • if the Customer has modified or damaged the item or taken action which prevents us from making a proper assessment of any claimed fault or defect

  • for products purchased and used for on-selling or hiring to or third parties

  • with respect to ordinary wear and tear or fatigue

  • if the item has been supplied to the customer free of charge or as a subscription bonus

Warranty Exclusions and Disclaimers

Items sought to be repaired/replaced under warranty must be returned to us in the same manner as they were originally delivered. 

If the item:

  • is determined not defective, faulty, defective or spoiled upon testing by us;

  • tests as working fine; or

  • the issue relates to user error

 all costs of postage, return postage (to re-deliver the products) and testing shall (if charged) shall be covered by the claimant.

Unavailability

In the event an advertised item is unavailable or oversold we may elect to substitute a like product in which event or we may hold the entire order

 

until the item is in stock (provided within 14 days).  We shall only send the item separately if the customer pays any additional delivery or postage.

Items in your shopping basket are not reserved and may be purchased by other customers

Australian Consumer Law (ACL)

These terms shall not remove or effect any guarantee or obligation otherwise existing by virtue of the ACL

Intellectual Property Rights​

Your use of this site does not authorise you to use any of our intellectual property which includes copyright, designs or any Trademark.  Any use

 

reproduction or redistribution of our intellectual property is strictly prohibited (unless authorised by us in writing) and any infringement may result in

 

criminal or civil prosecution.

 

Your Activity

You agree that you will be personally responsible for your use of this Site and for all of your communication and activity on and pursuant to this Site

 

or on any social media activity concerning this business.

 

.If we determine that you are or have been engaged in prohibited activities, were not respectful of other users, or otherwise violated these terms, we

 

may deny you access to this Site (or to any related social media group) on a temporary or permanent basis.  You authorise us to contact the Group

 

controller to request you be denied access if we do not  control such media.

Disclaimer

To the Extent permitted by Law it is agreed that we shall not be liable to you with respect to any losses, damages or injuries caused by us

 

through use of our products or otherwise.

KegClub/Subscription

Additional to the terms and conditions above the following apply with respect to KegClub/Subscription purchases.

  • First KegClub order delivered within 7 days, subsequent orders delivered third week every month

  • Deliveries shall be to the address you have supplied

  • By joining KegClub you authorise us to debit your nominated credit card with the agreed monthly charge prior to dispatch

  • Minimum subscription on all KegClub plans is 3 months. Ongoing subscriptions may be cancelled anytime after by emailing

       orders@minikegz.com (excludes orders in process).  

  • Upgrade plan at anytime without penalty

  • Club Members will enjoy a 10% discount on all subsequent purchases from MINIKEGz including all beverages and any hardware items (but

 

       excluding specials/promotions)

  • Club Members will always pay less that normal RRP for their selections

  • Due to price variations KegClub selections exclude cocktails and occasional unique offerings. KegClub members can still purchase these at 10%

       discount

  • Bonus Beer Gear will apply only on customers first subscription, not on a subsequent subscription or renewal
